When Can NY and NJ Animal Control Evict Bats

Bats occupy an interesting place in the world of pest control. They are beneficial animals that manage populations of insects like mosquitoes, moths, crickets, and beetles. When Can We Exclude Bats in New York
Exclusion is a safe and effective alternative to extermination. Instead of killing bats or harming them in any way, we set up devices that allow bats to safely leave on their own, but make it impossible for them to come back in the next morning.

But this means that exclusion is only effective when bats are leaving their property. It also means that, since they cannot come back, it needs to be safe for them to leave permanently and find a new place to live. If neither of those things are true, excluding bats can harm them. For customers in New Jersey, the NJ Division of Fish and Wildlife has issued specific dates between which bat exclusions can legally occur. In the state of New York, there are no mandated times, but we must ensure that bats are not breeding or hibernating. We therefore use a similar schedule for New York customers. This schedule prohibits exclusions between:

  • May 1 to July 31 – No exclusion is possible as this is when baby bats are present.
  • October 16 to March 31 – No exclusion is possible since bats are in hibernation.
    This leaves acceptable bat exclusion times between:
  • April 1 to April 30
  • August 1 to mid-October

Scheduling Bat Exclusion Around Hibernation
New York is home to six species of cave bats who stay in the area to hibernate during the winter. Of the six, the big brown bat often uses man made structures for its winter hibernation. The bats enter torpor – a state of lowered temperature and heart rate – when temperatures cool in mid-October and come out of it around April. During this time, they use their fat reserves to sustain themselves.  Exclusion in winter months is ineffective since the bats are not leaving their roosts nightly to hunt. Additionally, disturbing hibernating bats is extremely harmful as each time a bat comes out of torpor uses up vital energy reserves. Too many disturbances can result in death before bats can resume hunting insects in the spring.

Understanding Types of Bats in Your Home
Of New York’s nine bat species, there are 6 that are most often an issue for homeowners. These are called cave bats as they prefer to roost in groups in sheltered spaces like caves and mines out in nature. But when they dwell in urban areas, attics, sheds, walls, chimneys, bridges, and other crevices in man-
made structures provide their shelter. The most common cave bat invaders in homes are:

  • Big Brown Bat
  • Little Brown Bat
  • Northern Long Eared Bats

The other 3 cave bats can also make their homes in houses. These are the Indiana bat, eastern small- footed bat, and tricolor bat. The big brown bat is the only one that will hibernate in homes through the winter. The others will leave their roost for a more natural location. The Indiana bat, northern long eared bat, and eastern small- footed bat are protected under NY state and federal law as endangered or threatened species at risk of becoming endangered. Attempting to remove these three species outside of the permitted exclusion schedule, or harming them at any time of the year, can result in costly penalties.

Rules and Regulations for Endangered Bats in NYC

How the Bat Life Cycle Impact Exclusion Timing
Female bats give birth to baby bats in June and July. For the first weeks after the pups are born, a time called the maternity season, the young bats stay in their roost each night while the mother bats go out to hunt for food. The young bats master flying around August, at which point they will begin leaving to
find their own food.

Exclusion is not possible during the maternity season since pups are not leaving their roost and are depending on adult bats to return to feed them. If we were to use bat exclusion in the summer, it would result in the death of a generation of bats. We schedule bat exclusion around the maternity season because it:
